JUDGEMENT

(1.) HEARD counsel appearing for the petitioner and counsel appearing for the State. Petitioner is an accused in this case registered under Sections 392 of the Indian Penal Code and thereafter, Section 411 of the Indian Penal Code is also added.

(2.) COUNSEL appearing for the petitioner has submitted that the name of the petitioner has come only on the basis of confessional statement of the co -accused. It is further submitted that the looted motorcycle has been recovered from the possession of Bandhan Tirkey. It is further submitted that the said Bandhan Tirkey alias Bandhana Tirkey has already been granted bail by another Bench of this Court in B.A. No. 5654 of 2012 vide order dated 01.09.2012. It is also contended that the petitioner is in custody since 30th September, 2012 i.e. more than six months.
