JUDGEMENT

(1.) I .A. No. 6864 of 2013 has been preferred by the petitioners for early hearing of the case in the admission matter. However, learned counsel for the petitioners submitted that at this stage instead of deciding the issues on merit the respondents may be directed to consider their representation and take appropriate decision in accordance with law. Heard counsel for the parties.

IT is the contention of the petitioners that petitioner no.1 has been regularized as teacher at Mandar College, Mandar vide notification dated 20.7.2007 vide Annexure 7/1 and petitioner no. 2 has been regularized as teacher at B.N.Jalan College, Sisai by notification of the same date vide Annexure 7 issued by the Registar, Ranchi University against the subject shown before their names and also date of their regularization. Petitioners have approached this Court for payment of arrears of salary of the post of reader on which they were promoted on adhoc basis on completion of 8 years under the merit promotion scheme. However, they have suddenly been reverted to the post of lecturer. They have also grievance that their promotion have not been confirmed after undertaking due process and scrutiny by the University and recommendation to the Commission for onward decision in this regard.

HAVING heard counsel for the parties, at this stage, the writ petition is disposed of without commenting upon the merit of the case of the parties by allowing liberty to the petitioners to once again approach the Respondent Ranchi University through its Registrar with a fresh representation(s) for rederessal of their grievances within a period of 3 weeks duly supported with all facts and documents through proper channel i.e. through the Principal of the respective college in which they are working. On receipt of such representation(s) the competent Authority under the Respondent Ranchi University shall examine the cases of petitioners in accordance with law and the prevalent statute after verification of the service records of the individual petitioner and take an informed decision in the matter by following the laid down procedures. So far as the claim of the petitioners relating to the promotion to the post of reader is concerned, respondent Ranchi University, if are required to place the matter before the duly constituted Screening Committee, the same may be done and depending upon the decision of the Screening Committee, appropriate recommendation, if necessary be made to the respondent 6, Jharkhand Public Service Commission for taking a decision in the matter. Let the said exercise be conducted by the Competent Authority under the Ranchi Unversity within a period of 12 weeks from the date of receipt of the representation(s).The respondent No.6, J.P.S.C shall, thereafter on receipt of such recommendation, if any, shall take an appropriate decision in accordance with law within a period of 10 weeks, thereafter.
