JUDGEMENT

(1.) In this application, the appellant has prayed for his release on bail, during pendency of this appeal.

(2.) Learned counsel for the appellant submitted that though the appellant's same prayer was earlier rejected by this Court on merit, he has remained in custody for more than five years, after conviction; the appellant's conviction is based on the testimony of P.Ws - 4 & 5, who claim to be the eye-witnesses, but the other evidences on record contradict that claim; there was inordinate delay in lodging the F.I.R and the case is suspicious.

(3.) Learned A.P.P opposed the appellant's prayer for bail and submitted that the appellant's same prayer was earlier rejected by this Court on merit; the appellant's conviction is based on the testimony of the eye-witnesses; no fresh ground has been made out to reconsider the appellant's prayer, except that he has remained in custody for some more period.
