SIKANDER BHARTI Vs. STATE OF JHARKHAND

JUDGEMENT

(1.) HEARD the counsel for petitioner and counsel for the State. The petitioner is an accused in this case registered under Sections 364 /34 of the I.P.C. pending in the Court of Principal District & Sessions Judge, Chatra.

(2.) THE counsel for the petitioner submits that though the petitioner is named in the F.I.R. but it has come in the investigation that the petitioner was also with the co -accused namely Pun Bharti. It is also submitted that the victim girl has stated in her statement recorded under Section 164, Cr.P.C., that she has love affairs with the said Pun Bharti. It is also contended that the Pun Bharti has been granted bail by another Bench of this Court in B.A. No. 3665 of 2012 vide order dated 1.7.2012. It is also submitted that the petitioner is in custody from 20.10.2011 i.e., nearly 1 1/2 years.
