ARUN MEHTA Vs. STATE OF JHARKHAND AND OTHERS

JUDGEMENT

(1.) HEARD counsel for the parties. It is the case of the petitioner that he had inadvertently, while filing the application form for participating in the Teacher's Eligibility Test, 2012 marked the relevant column as General category candidate, though he belongs to the category of other Backward Classes and subsequently, when the result of published (annexure -5) the petitioner was shown scoring 83 marks out of 150 and has been declared not qualified. A candidate of General category requires to score 60% marks and those belonging to Scheduled Castes, Scheduled Tribes, Backward Classes as well as handicapped category are required to obtain 52% marks.

LEARNED counsel for the petitioner submits that he immediately made representation before the respondent - JAC for correction of such mistake and if such correction is allowed he may possibly be declared a qualified candidate as he has scored 83 out of 150, which is more than qualifying marks for the most Backward Classes candidate. He has also made representation vide annexure -6, which has not yet been decided by the respondent - Jharkhand Academic Council.

IN that view of the matter, without getting into the merit of the controversy, petitioner is allowed to approach the respondent No. 4, Secretary, Jharkhand Academic Council for redressal of his grievance by filing a fresh representation within a period of 2 weeks with all supporting facts and documents. The respondent No. 4, on such representation, shall consider the same in accordance with law and pass a reasoned and speaking order within a period of 4 weeks, thereafter. The writ petition is disposed of in the aforesaid terms.
