MD ILLIYAS Vs. STATE OF JHARKHAND

JUDGEMENT

(1.) Heard learned counsel for the petitioner and learned counsel for the Vigilance. The petitioner is an accused in a case for the offence registered under Sections 7/13(2) of the Prevention of Corruption Act, 1988.

(2.) Learned counsel for the petitioner has submitted that according to the allegation that the petitioner has been caught red handed in the trap proceeding for demanding of Rs. 1,000/-. It is also contended that the petitioner is in custody since 17.04.2013 i.e. more than two and half months. It is also submitted that the petitioner is the senior citizen and he is going to be superannuated in November 2013.

(3.) Learned counsel for the Vigilance, Mr. Nilesh Kumar has opposed but he has not disputed the aforesaid contentions made by the counsel for the petitioner.
