JUDGEMENT

(1.) HEARD learned counsel for the parties.

(2.) THE petitioner is accused in connection with Sessions Case No.05 of 2013 arising out of Rajmahal P.S. Case No.354 of 2012 corresponding to G.R. Case No.634 of 2012, pending in the Court of learned Additional Sessions JudgeI, Rajmahal.

(3.) IT is submitted that all the family members of the petitioner were implicated in this case. As a matter of fact the petitioner was already taken in custody and after that an informatory petition was lodged in the Court of learned A.C.J.M. When a report was called for, the police booked the petitioner in this case and in between the victim was also released. The statement of victim cannot be relied upon
