JUDGEMENT

(1.) Heard the parties.

(2.) A case bearing Sonari P.S. Case No. 130 of 2012 was lodged by the opposite party no. 2-complainant alleging therein that he had purchased a flat by virtue of registered sale deed bearing no. 1795/1404 dated 30.3.2012 from a builder. After he purchased the flat he asked his driver to live in the said flat. On the day of occurrence, this petitioner came and dispossessed the driver of the complainant and took possession of the said flat. On such allegation a case was registered under Sections 120B, 452 and 379 of Indian Penal Code, first information report of which is being sought to be quashed.

(3.) Mr. Ananda Sen, learned counsel appearing for the petitioner, submits that whatever allegation has been made in the complaint, that is all false and the falsity of the allegation made by the opposite party no. 2 -complainant would be evident from the document annexed with this application.
