JUDGEMENT

(1.) HEARD learned counsel for the petitioner and learned counsel for the State. The petitioner is an accused in a case registered under Sections 147, 148, 149, 341, 342, 323, 325, 307, 225, 353 and 333, I.P.C.

(2.) COUNSEL for the petitioner has submitted that the allegation against the petitioner is that he along with 30 -40 persons named in the F.I.R. was sitting near a temple of the village and when the police party reached near the spot, some 100 -115 villagers from the nearby busti came there and obstructed the police party to arrest the present petitioner. It is further submitted that there is no specific allegation against the petitioner though he is named in the F.I.R. It is further submitted that the petitioner is in custody from 27.11.2012 i.e. more than three months.
