JUDGEMENT

(1.) PETITIONER by way of filing the present writ petition under Article 227 of the Constitution of India has prayed for issuance of an appropriate writ/ order/ direction to the learned Principal Judge, Family Court, Dhanbad to dispose of the petition dated 19.10.2012, which has been filed by the petitioner for stay of the proceeding of Title (Matrimonial ) Suit No. 134/2012 filed under Section 10 of the Code of Civil Procedure.

(2.) UPON hearing the learned counsel for the petitioner and on perusal of the material placed on record, let notice be issued to the respondent, on her present and correct address, under registered cover with A/D as well as by ordinary process, for which requisite etc. must be filed within one week.

(3.) LEARNED counsel for the petitioner states that the court-below time and again passed the order of personal appearance of the present petitioner-defendant. The last order, issued by the court, asking the personal appearance of the present petitioner-defendant, is placed on record indicating 22.1.2013 for physical appearance of both the parties. According to the learned counsel for the petitioner on 22.1.2013 once again similar order has been passed.
