JUDGEMENT

(1.) COUNSEL appearing for the petitioner submits that in this case, the F.I.R. was lodged on 11/12.08.2011 and the offence was registered under Section 363 of the Indian Penal Code.

(2.) JUDICIAL Magistrate, 1st Class, Giridih has to take cognizance of the case and he has to commit the case to the Sessions Court, Giridih for trial.

(3.) WE , therefore, direct the Registrar General of this Court to place this matter before the Hon'ble the Chief Justice of this Court for taking appropriate administrative decision in the matter because Judicial Magistrate, 1st Class, Giridih, since long is not taking cognizance and not committing the case to the Sessions Court, Giridih. The Registrar General of this Court will immediately place this matter before the Hon'ble the Chief Justice of this Court.
