JUDGEMENT

(1.) HEARD the learned counsel for the parties.

(2.) IN this application the petitioner has prayed for quashing of the order dated 13.2.2002 passed by the Judicial Magistrate, Latehar in Complaint Case No. 90 of 2001 whereby the learned Magistrate took cognizance of the offence under Sections 147/379 of the Indian Penal Code and Section 3/4 of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989 (hereinafter referred to as the Act) against the petitioner.

(3.) THE learned Additional Chief Judicial Magistrate, Latehar, after registering the complaint, transferred the same to the court of Judicial Magistrate, Latehar under Section 192 Cr.P.C. for enquiry and trial.
