JUDGEMENT

(1.) THE appellant was appointed as Assistant Teacher in a Primary School on 27th June, 1986 in Matric Trained Scale.

(2.) EARLIER the promotion of assistant teacher in I.A./I.Sc. and B.A./B.Sc. trained scales were guided by different circulars and orders, which were subsequently repealed by the Bihar Take Over Elementary School Teachers Promotion Rules, 1993 which came into force with effect from 1st January, 1986.

(3.) UNDER Rule 5 of the 1993 Rules minimum eight years' teaching experience was required for such promotion.
