(1.) Heard learned counsel for the parties. The prayer in the writ application was for directing the respondents to enhance the upper age for appointment of Primary Trained Teachers under the respondents up to the age of 55 years, by modifying the notification dated 6th of March 2003. They had also prayed for consequential orders by granting them opportunity upon such relaxation of age.

Counsel for the respondent JPSC submits that the same issue was squarely raised and decided by this court in a batch of writ petitions being WP(PIL) No. 2769 of 2003 and analogous cases which has been. It is further submitted that by order dated 1st August, 2003, this case was ordered to be placed after disposal of W.P.(S) No. 1742 of 2003. The said writ petition (WPS 1742/03) is one of the analogous cases which has been decided in the aforesaid reported cases by the Division Bench of this court. From perusal of the such judgment, it appears that the Division Bench of this court in fact, has observed that those who did not possess the requisite age qualification as per the amended Rule 4(d) of the Rules, even if they have written the examinations, would not be considered for recommendation, selection or appointment by the Commission or by the Government It therefore appears that the issue raised in the present writ application was considered and decided in the judgment referred to above , no relief can be granted in the present writ application. It is accordingly dismissed.
