JUDGEMENT

(1.) LEARNED counsel appearing for the Respondents submits that an amount of Rs. 4,54,211/ - has already been paid to the petitioner. He further submits that a cheque of Rs. 2,28,476/ - shall be issued to the petitioner on 30th November, 2012. Petitioner can collect the cheque of Rs. 2,28,476/ - on 30th November, 2012 from the office of Respondent No. 5. He further submits that the outstanding amount of Rs. 4,64,967/ - may be permitted to be paid to the petitioner in installments, considering the poor financial condition of the Authority. Learned counsel for the Respondents further submits that the petitioner may file representation, claiming the benefits of ACP and 5th Pay Revision, within 30 days and appropriate decision shall be taken thereon preferably within ninety days thereafter, in accordance with law.

(2.) UNDISPUTEDLY , petitioner stood retired on 31.01.2007 from the post of Assistant Analyst, Mineral Area Development Authority, Dhanbad and the petitioner is being deprived of his legitimate dues, for no fault of him.
