JUDGEMENT

(1.) HEARD learned counsel for the petitioners learned counsel for the State as also learned counsel for the complainant opposite party No.2.

(2.) THE petitioners are aggrieved by the order dated 28.2.2004 passed by Sri S.S. Yadav. learned Judicial Magistrate 1st Class. Dhanbad in C.P. No. 06 of 2003, whereby the application filed by the petitioners for dropping the criminal proceedings against them for the offences under Sections 304 -A and 201 of the Indian Penal Code. has been rejected by the Court below.

(3.) FURTHER alleging that the Complainant in order to collect use documents pertaining to the treatment of his nephew Sailesh Kumar went to Central Hospital on 26.11.2002. but he could know that the efforts had been made by the accused persons to remove the evidence against them the complaint petition was filed against the petitioners for the offences under Sections 304 -A and 201 of the Indian Penal Code on 3.1.2003 in the Court of the Chief Judicial Magistrate. Dhanbad which was registered as C.P. No. 6/2003.
