(1.) Heard the counsel for the petitioner and the counsel for the State.
(2.) The petitioner is apprehending his arrest in this case registered under Sections 467, 468, 471, 414, 420, 120(B)/34 of the Indian Penal Code and Section 21 of the M.M.R.D. Act, in connection with Jamtara P.S. Case No.1 of 2011, corresponding to G.R.No.3 of 2011, pending in the court of Chief Judicial Magistrate, Jamtara.

The prosecution case n brief is that the first informant report on the basis of the written report of Ishwar Dayal Singh,S.I., Jamtara, has been lodged alleging therein that on 30.12.2010, the informant received information that 8-10 trucks loaded with illegal coal on forged documents are coming from the side of Mihijam, and on this information, the informant along with the police party proceeded and reached at Jamtara Railway Crossing and seeing the trucks, stopped the trucks and started checking and in course of checking, it was found that the papers produced by the drivers of the trucks for the coal loaded on their trucks were forged and on being asked, the drivers told the informant that Moti Rehman of Chirkunda has given them all those papers and according to his direction, the coals were loaded on their trucks.
