JUDGEMENT

(1.) PRAYER made in the present writ petition is to issue a writ of mandamus commanding the respondent - Jharkhand Public Service Commission to prepare fresh merit list of the 2nd Civil Services Examination from the candidates, who were not selected in the original merit list, on the ground that merit list prepared of the 2nd Civil Services Examination is being investigated by the CBI, on the direction issued by this Court and the selected and appointed candidates of the merit list of the 2nd Civil Services Examination were directed by this Court not to work during the pendency of the investigation and the matter is sub -judice before the Hon'ble Apex Court. In the firm opinion of this Court, merely because first merit list of 2nd Civil Services Examination is being investigated by the CBI, no direction can be issued to the Jharkhand Public Service Commission to prepare a fresh merit list from the candidates, who were not selected in the first merit list.

(2.) THE present petition is misconceived and is hereby dismissed.
