JUDGEMENT

(1.) THE petitioner has sought direction on Respondent No. 2 for allowing him to appear in Post Graduate Teacher Examination, which is going to be held on 15th February, 2012. It has been submitted that the petitioner fulfills all the criteria for appearing in the said examination. The petitioner has also deposited examination fee, but the admit card has not been issued to the petitioner. There is no valid ground for preventing the petitioner from appearing in the examination.

(2.) LEARNED Counsel, appearing on behalf of Jharkhand Academic Council, contested the writ petition and submitted that the petitioner claimed reservation in OBC Category, but he has not submitted the caste certificate issued by the competent authority In proper format. The petitioner cannot be allowed to sit in the examination as OBC Category. Since the petitioner has not claimed his candidature as general candidate, admit card has not been issued to him.

IN view of the said submissions and the facts and circumstances of the case, this writ petition is disposed of, directing the Secretary, Jharkhand Academic Council -Respondent No. 2 to issue admit card, showing him in General Category, If there is any difficulty in issuing admit card In OBC Category and to allow the petitioner to sit in the examination as General Category. Learned Counsel for the respondents submitted that this order will be communicated to the Respondent No. 2 right now, keeping in view of the urgency of the case.
