COSMIC CONSTRUCTION PRIVATE LIMITED Vs. STATE OF JHARKHAND

JUDGEMENT

(1.) The grievance of the petitioner is that though he has completed the work of construction of tourist complex at Daltonganj, the admitted amount of Rs.46,88,444/ - has not been paid till date. The said amount is admitted dues, which would be evident from the report submitted by a Committee, headed by the Chief Engineer, Tourism Department (Annexure4).

(2.) LEARNED counsel appearing on behalf of the respondents submitted that the Managing Director, Jharkhand Tourism Development Corporation Limited, Ranchi Respondent No.3 is the competent authority to look into the petitioner's grievance and pass appropriate order. If the petitioner files a fresh representation before the said respondent, the same shall be considered and appropriate order shall be passed in accordance with law.

(3.) IF the petitioner's amount/claim is found due and not yet paid, the admitted amount shall be paid to the petitioner within six weeks thereafter. If the amount, payable to the petitioner, is not paid within the said period, the same shall carry interest @ 10% per annum from the date the amount is found due till final payment.
