SRISTIDHAR MAHTO Appellant
V/S
STATE OF JHARKHAND Respondents

JUDGEMENT

(1.) 06/16.05.2012: The grievance of the petitioner is that on the petitioner's land appertaining to Khata No.109, Khewat Nos.9/1, 9/2 & 9/3 of village Sigid, P.S. Sonahatu, District Ranchi, the respondents are constructing bypass road without any acquisition of the land and without paying any compensation. The petitioner protested against the same and filed representations before the concerned authorities, but the same have also fallen on the deaf ears. The petitioner has to ultimately file this writ petition under that circumstance. Learned counsel for the petitioner submitted that since the road is being constructed for the public purpose, he has no intention to disturb the project, but at the same time proper compensation should be paid to him for the loss of his land.

(2.) LEARNED Standing Counsel (Land & Ceiling) appearing on behalf of the respondents submitted that if the land over which the road is being constructed belongs to the petitioner, his claim shall be considered by the Deputy Commissioner, Ranchi, who will get the petitioner's claim enquired into and pass appropriate order in accordance with law.
