GOPI DAS Vs. STATE OF JHARKHAND

JUDGEMENT

(1.) Bail application filed by Gopi Das and Laljee Das, is moved by Sri Mithlesh Singh, learned counsel for the petitioners and opposed by Sri S. Mahto, learned Additional P.P. for the State.

(2.) In the first information report, there is no allegation that these petitioners assaulted deceased (father of informant). The allegation against these petitioners that they assaulted informant and his mother with lathi, due to that they received simple injury. It appears that petitioner no. 1 is in custody from 08.08.2011 and petitioner no. 2 is in custody from 01.10.2011.

(3.) Considering the aforesaid facts and circumstances, I allow this application and direct the court below to enlarge the petitioners on bail on their furnishing bail bond of Rs. 10,000/-(Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Principal Sessions Judge, Dumka, in connection with Jarmundi P.S. Case No. 68 of 2011 corresponding to G.R. Case No. 534 of 2011.
