JUDGEMENT

(1.) HEARD the counsel for the parties.

(2.) THE writ petition has been filed for restraining the respondents from auctioning the respective shops alloted to petitioners at Simdega Market Complex, which was provided to them after completion of all required formalities, since the respondents are adopting pick and choose police without taking into consideration the observation made by this court in W.P.C. No. 4859 of 2004 dated 7.7.2006

(3.) NO rejoinder to the said counter affidavit has been filed by the petitioners nor the aforesaid contention of the respondents have been denied.
