JUDGEMENT

(1.) By Court. No one appears on behalf of the appellant.

(2.) This appeal is directed against the judgment of conviction and order of sentence dated 30.09.2002 and 01.10.2002 respectively, passed by learned Sessions Judge, Dumka, in Sessions Case No. 298/2000, convicting the appellant under section 302 IPC and sentencing him to undergo R.I. for life.

(3.) The prosecution case in short is that the informant P.W-1 lodged a fardbeyan on 28.8.2000 at 9 a.m. to the effect that there was land dispute between her husband and his brothers. On 27.8.2000, at about 5 P.M., the appellant took her husband-Jatu Soren for drinking liquor and there they started quarreling. Thereafter the appellant assaulted her husband-Jitu Soren by a wooden plank on his head, due to which he died.
