JUDGEMENT

(1.) THE case of petitioner is that he was engaged on daily wage on 30.11.1991 and working as Assistant in the office of BDO, Dumaria. Such engagement was made during the strike of non -gazetted employees and work of petitioner having found satisfactory, was allowed to continued till 27.7.1999 whereinafter he is being prevented from work.

(2.) IT is alleged that the aforesaid action on the part of the respondents amounts to oral termination though they have retained persons engaged on daily wage after the petitioner, namely, Ashwini Kumar.

(3.) IF any representation is preferred by the petitioner within three weeks, the Deputy Commissioner, East Singhbhum Jamshedpur in his turn will determine the claim by a reasoned order within a period of three months from the date of receipt of such representation.
