JUDGEMENT

(1.) This appeal has been preferred by the opposite party -appellant, the Oriental Insurance Co. Ltd. (Company for short) against the order dated 18th February, 1998 passed by the learned single Judge in Misc. Appeal No. 200/1995 (R).

(2.) THE learned single Judge observed that the appeal having filed against an interim award passed by the Claim Tribunal under Section 140 of the Motor Vehicles Act, the issue raised was not required to be answered and can be determined at the time of hearing of the main application. - -

(3.) ADMITTEDLY , the deceased, Bhudev Paul was the owner of the auto -rickshaw bearing Registration No. BR -14A -8538 who was driving the vehicle, and met with an accident due to ditch on the road. The vehicle of the deceased being insured with the insurer. Learned Claims Tribunal allowed a sum of Rs. 25,000/ - (Rupees twenty five thousands) only with interest in favour of the claimants.
