JUDGEMENT

(1.) This application has been preferred by the petitioner against Bill No. 5212 dated 4th April, 1998, wherein the Respondents i.e. the officials of the then Bihar state Electricity Board (now Jharkhand State Electricity Board) raised demand of Rs. 86,598/ - towards energy charge for the period May, 1985 to 4th April, 1998.

ACCORDING to the petitioner, he is a domestic consumer, having Connection No. JHD -267 HRD 468, using two Bulbs of 60 Watts during night, but the Respondents wrongly showing the connected load as 2 KW, have raised the bill, in question. The energy bill has been raised on average basis as 200 units per month without any basis. 2001 (1) JLJR 111. In the said case, the Court held that Clause 16.8 of the Agreement though empowers the Board to assess the bill giving the period while the meter was out of order, either on the basis of average consumption of previous three months or average consumption for the corresponding three months of the previous year or the MMG, whichever is the highest, but while raising the bill, the Board must take into consideration the average three months consumption of the previous three months and maintain rational while raising the bills. 4. In the present case, as it has not been made clear as to how the average billing was made, the case is remitted to the Electrical Superintending Engineer. Electrical Circle, Dhanbad to forward the petitioner the details of previous three months bills on whose average, the Board intends to charge for the period from May, 1985 to 4th April, 1998 within a period of two months from the date of receipt/production of a copy of this order.
