HINDUSTAN COKE INDUSTRIES, THROUGH ITS PROPRIETOR AND ANR. Vs. CHAIRMAN-CUM-MANAGING DIRECTOR, BHARAT COKING COAL LTD. AND ANR.

JUDGEMENT

(1.) This writ application has been preferred by the petitioners for a direction on the respondents to release full quota of coal in terms of linkage. Their grievance is that the total quantity of coal, as shown in the linkage, is not being supplied rather lesser quantity is being supplied.

(2.) From the pleadings and enclosures, it appears that the respondents are supplying coal on the basis of Maximum Permissible Quantity (MPQ).

(3.) The question relating to supply of coal on the basis of MPQ fell for consideration before this Court in the case of Maya Fuel Private Limited v/s. Bharat Coking Coal Limited and Ors., W.P. (C) No. 4790 of 2001 reported in, 2002 (3) JCR 196 (Jhr). In the said case, the Court vide judgment dated 14th August, 2002, held as follows : - -
