ANITA TIRU Vs. STATE OF JHARKHAND

JUDGEMENT

(1.) HEARD the parties. This case relates to payment of death benefits, such as, family pension, provident fund, gratuity, group insurance, unpaid salary etc.

(2.) ACCORDING to the petitioner, she is legally adopted daughter of late Amy Tiru, who was the Nurse Sister in M.G.M. College and Hospital, Jamshedpur and died in harness on 19th September, 1992. The petitioner claims to have obtained succession certificate in Succession Case No. 348 of 2000 and alleges non -payment of the dues aforesaid.

(3.) IN the facts and circumstances, the case is remitted with a liberty to the petitioner to bring the matter to the notice of the Superintendent, Rajendra Medical College and Hospital, Ranchi, and Superintendent, Mahatma Gandhi College and Hospital, Jamshedpur, who will enquire into the matter and pay the admitted post death benefits to the legal heir of late Amy Tiru, within three months from the date of receipt/production of a copy of this order, if not yet paid. The respondents will take into consideration the succession certificate, if any, which the petitioner so produces.
