JUDGEMENT

(1.) THE writ petition has been preferred by petitioner for direction on respondents to consider his case for promotion to the higher post of Assistant Engineer w.e.f. the date his juniors such as Harish Chandra Chaki Diggi - respondent No. 6 and Uttam Kujur respondent No. 7 have been promoted.

(2.) THE case of petitioner is that he was appointed as Junior Engineer on 29th December, 1987 in the Road construction Deptt. of State of Bihar. He was posted in the R.E.O., Singhbhum and since then he is working under the State. The seniority list of Junior Engineers was published on 8th Feb., 2000 wherein the name of petitioner has been shown at SI. No. 3159. The juniors such as Harish Chandra Chaki Diggi and Uttam Kujur their names have been shown below the name of petitioner at serial No. 3322 and 3323 respectively. The service records were called for consideration of cases for promotion on 4th May, 2000 which was sent earlier on 28th of May, 1999. The case of petitioner having not been considered, the petitioner had to move before this Court in C.W.J.C. No. 2355 of 2000 (R). A Bench of this Court vide its order dated 2nd August, 2000 disposed of the writ petition with a direction to the respondents that as and when the matter with regard to promotion of Junior Engineers to the post of Assistant Engineers is taken up, the petitioner 's case shall also be considered.

IT is stated that before reorganization no final notification was issued but after reorganization of the State the juniors namely Harish Chandra Chaki Diggi and Uttam Kujur who are also posted in the State of Jharkhand they have been promoted vide Govt. of Bihar notification dated 22nd September, 2001 followed by notification No. 5165 and 5166 issued by State of Jharkhand dated 27th of December, 2001.
