Learned senior counsel appearing for the petitioner submitted that the present writ petition has been preferred against the order passed by learned Additional District Judge, Fast Track Court-V, Dhanbad dated 24th July, 2010 in Title Appeal No. 86 of 2009, whereby the additional evidence laid by the present petitioner (appellant in Title Appeal No. 86 of 2009) has been ordered to be considered at the time of final hearing of the said appeal.
(2.) Having heard learned Counsels for both sides and looking to the facts and circumstances of the case, it appears that:

In view of the aforesaid facts, the document, which is presented by the petitioner (appellant in Title Appeal No. 86 of 2009) i.e. compromise entered into between one of the plaintiffs and the petitioner shall be considered as per provision of Order XLI Rule 27 of the Code of Civil Procedure, at the time of hearing of Title Appeal No. 86 of 2009.
