IRSHAD ANSARI Vs. STATE OF JHARKHAND

JUDGEMENT

(1.) Heard learned counsel for the petitioner and the learned counsel for the State.

(2.) This is an application for grant of regular bail to the petitioner in a case registered under Section 379 IPC. It is submitted by the learned counsel for the petitioner that the looted motor cycle was recovered from the house of Mustakim Ansari and Mustakim Ansari disclosed that the vehicle was purchased by him from one Kalim Ansari on the mediation done by wakil Ansari and Irshad Ansari. It is further submitted that said Wakil Ansari has been released on bail in B.A.No.7543/2010 and the petitioner has remained in custody since 2.2.2010 and as such, he may be released on bail. Learned counsel for the State opposed the prayer for bail.

In the facts and circumstances and considering the period of custody of the petitioner, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of SDJM Gumla in connection with Gumla P.S.Case No.77/2009, G.R. No.262/2009, subject to the condition that one of the bailors will be close relative having property within the jurisdiction of the court concerned. .
