JUDGEMENT

(1.) From the facts of the case it appears that this case can be settled amicably between the parties. Under the said circumstance, petitioner is directed to implead complainant as opposite party no. 2. Issue notice to opposite party no. 2 under Registered cover with A/D as well as by ordinary process, for which requisites etc. must be filed within one week, failing which, this application shall stand rejected without further reference to a Bench.

(2.) In the meantime, petitioner namely Niraj Kumar shall not be arrested in connection with Complaint Case No. 180 of 2009 pending in the court of Sri Abhash Verma, learned Judicial Magistrate, 1st Class, Palamau at Daltonganj
