JUDGEMENT

(1.) Heard learned counsel for the parties.

(2.) Petitioner is accused in a case registered under Section 376 of the Indian Penal Code in connection with Sessions Case No.158 of 2010 arising out of Ramgarh P.S. Case No.14 of 2010, corresponding to G.R. Case No.132 of 2010 which is pending in the Court of learned Sessions Judge, Dumka.

(3.) It is alleged that the victim was subjected to rape by the petitioner on the point of pistol while she had gone to answer the call of nature.
