JUDGEMENT

(1.) THE petitioner is an accused in the case registered under Sections 414 and 34 of the Indian Penal Code and Section 7 of the Essential Commodities Act.

(2.) LEARNED counsel appearing on behalf of the petitioner submitted that the petitioner has been falsely implicated in this case; he is a driver of the truck and the fertilizer was supported by valid papers; however, the same was seized and the petitioner was not with the truck; subsequently, the fertilizer bags were released in favour of purchaser who had valid documents; petitioner is in custody since December, 2010; he is a local permanent resident; there is no chance of his absconding.
