JUDGEMENT

(1.) This Criminal Revision is directed against the judgment impugned passed by the learned Principal Judge, Family Court, Deoghar in Criminal Misc. Case No. 08/2010 on 26.07.2010 in a proceeding under Sec. 125 of Code of Criminal Procedure by which the liability has been fixed upon the petitioner to pay maintenance to the tune of Rs. 5,000/ (five thousand) per month to his wife opposite party Anupma Kumari from the date of filing of Criminal Misc. Case No. 08/2010 i.e. from 19.01.2010. The petitioner has been further directed to pay Rs. 2,000/per month in addition to regular maintenance of Rs. 5,000/and in that way the petitioner was asked to pay total to a sum of Rs. 7,000/per month till the adjustment of the entire arrear amount.

(2.) Heard Mr. Afaque Ahmad, learned counsel appearing on behalf of the petitioner and Mr. Vijay Shankar Jha learned counsel appearing on behalf of the opposite partywife.

(3.) The learned counsel for the petitioner admits and submits that though the petitioner husband appeared in the proceeding under Sec. 125 of the Cr. P. C. since he was undergoing treatment for his back pain he left taking steps in the said proceeding midway. The petitioner has annexed the certificate issued by Dr. P. K. Jha, Civil Assistant Surgeon in support of the contention.
