JUDGEMENT

(1.) HEARD learned counsel appearing for the appellant and learned counsel appearing for the State on the matter of limitation.

(2.) ON being satisfied with the grounds made in the interlocutory application, the delay of 66 days in filing the appeal is condoned. I.A. No.167 of 2011 is disposed of.

(3.) IN the circumstances, during pendency of the appeal, the appellant above named is directed to be released on bail on his furnishing his personal bond and two sureties of Rs.20,000/- (Rupees Twenty Thousand) each to the satisfaction of trial court (Additional District & Sessions Judge, FTC-V, Godda) in connection with Sessions Trial Nos.120 of 2008 and 218 of 2008, subject to the conditions that one of the bailers will be his close relative and other should have landed property within the local jurisdiction of the Court.
