NAGESHWAR YADAV Vs. STATE OF JHARKHAND

JUDGEMENT

(1.) This application for grant of regular bail in connection with S.T. No. 193 of 2010 arising out of Simaria P.S. Case No. 94 of 2007 (G.R. Case No. 587 of 2007), registered under Section 147, 148, 149, 302 I.P.C. and Section 17(i)(ii) of the C.L.A. Act, pending in the court of learned 1st Additional Sessions Judge, Chatra has been filed on behalf of petitioner, named above.

(2.) It reveals from the F.I.R. that husband of the informant was forcibly kidnapped by the petitioner and his associates between intervening night of 9-10 July, 2007. On the next day, the dead body of the husband of the informant was detected and this case was lodged.

(3.) It is submitted that except the informant nobody else has supported the prosecution case. The petitioner is in jail since 3.6.2010.
