JUDGEMENT

(1.) HEARD learned counsel for the appellant, learned counsel for the informant and learned counsel for the State.

(2.) THE prosecution story is very unnatural. In fact, the prosecution story has been built up in the F.I.R after the dead body was found. THE murder is not committed on light pretext normally. Serious motive is required. THE deceased voluntarily accompanied the accused in their vehicle without even informing his brother, who was also sleping at the hotel, which, prima facie, indicates that the relation between the accused and the deceased was not sufficiently serious to create any apprehension in the mind of the deceased so as not to accompany the accused all alone. That being the situation, it is difficult to believe that suddenly the accused would commit murder of the deceased.
