JUDGEMENT

(1.) Heard learned counsel for the parties.

(2.) Petitioner is accused in a case registered under Sections 147, 148, 149, 353 & 307 of the Indian Penal Code, Section 27 of Arms Act and Section 17 of C.L.A. Act and Section 13 of U.A.P. Act.

(3.) It reveals from the First Information Report that after receiving information that M.C.C. extremists have assembled at village Madhukamdih at Tamar Police Station, the police raided the place after which exchange of firing took place between the extremists and police. In the incident one of the constable had sustained bullet injury. After some time the miscreants fled away but two of them including the petitioner were apprehended after chase. The companion of the petitioner was found in possession of M.C.C. literature and both of them confessed before the police that they are the members of Krantikari Kisan Committeee and they had come to attend a meeting.
