JUDGEMENT

(1.) Instant interlocutory application has been filed on behalf of the petitioner for stay of warrant of arrest issued against the petitioner from the court of Judicial Magistrate, Ranchi in connection with Bariatu P.S. Case No. 83/2007.

(2.) Learned counsel Mr. Nilesh Kumar submitted that admittedly petitioner is a Government Contractor and during course of installation of pipelines, certain cables of the Jharkhand State Electricity Board were damaged by the labourers of the petitioner, to which petitioner expressed his readiness and willingness to get such damage repaired, but assessing the damage to the tune of Rs.50,000/-, a criminal case was instituted against the petitioner for no fault of his.

(3.) In the facts and circumstances, I am not inclined to stay the warrant of arrest that has been issued to the petitioner. However, petitioner may file anticipatory bail on the ground stated above, which may be considered. With this observation, this I.A. No.2794 of 2010 is disposed of. (Cr.M.P. No.971 of 2010) Mr. B.B. Sinha is appearing on behalf of the opposite party No.2. In that view of the matter, no notice need be sent. Let this petition be listed on 17th of January, 2011 under the heading For Admission for final disposal.
