JUDGEMENT

(1.) Counsel for the petitioner submitted that as the order has been complied with, he wants to withdraw this contempt case.

(2.) On the other hand, Mr. Mukesh Kumar, learned counsel for the Electricity Board by referring para8 of the show cause submitted that the petitioner made the application only on 16/08/2010 and, thereafter, he filed this contempt petition on 21/08/2010 and much prior to 13/09/2010 when he deposited the requisite fee for grant of fresh electric connection. He further submitted that this contempt case should be dismissed with cost.

(3.) The petitioner has not filed any rejoinder to the counter affidavit/ show cause filed on 13/12/2010. Thus, it becomes admitted that just on the 5th day of making application and much prior to deposit of requisite fee for grant of fresh electric connection, this contempt case was filed. Apparently, it is an abuse of the process of the Court.
