JUDGEMENT

(1.) Anticipatory bail application filed by petitioner, Raj Kishore is moved by Sri L.C.N. Shahdeo, counsel for the petitioner and opposed by Sri H.K. Shikarwar, Additional P.P.

(2.) It is alleged that petitioner had stolen electricity and put loss of Rs.5,000/- to J.S.E.B. Annexure 2 shows that petitioner has already deposited Rs.5,000/-. Considering the aforesaid facts and circumstance, I direct the petitioner, above named, to surrender in the court below by 18th January 2011.

(3.) If the petitioner surrenders by that time, learned court below is directed to enlarge him on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saraikella in connection with Adityappur P.S. Case No.209 of 2010 corresponding to G.R. No.567 of 2010, subject to the condition as laid down under Section 438 (2) of the P.C.
