(1.) IN this writ petition the petitioner has prayed for quashing the reasoned order passed by respondent No.2 by which the respondents have denied the benefit of monetary compensation to the petitioner.
(2.) IT has been stated that the petitioner is the widow of son of Late Dehati Mallah, Ex -General Mazdoor, Tetulmari Colliery. After his death some monetary compensation was paid to the petitioner. The petitioner is, thus, entitled to get the monetary compensation under the prescribed rule of BCCL.
(3.) HAVING heard learned counsel for the parties I find that the petitioner is daughter -in -law of Late Dehati Mallah, Ex -General Mazdoor of Tetulmari Colliery of BCCL. She had claimed monetary compensation after the death of Dehati Mallah. This petitioner had filed a writ petition being W.P.(S) No.2665 of 2002 for direction to the BCCL to provide compassionate appointment. The said prayer was not allowed but the management was directed to take a decision on the matter of payment of monetary compensation to the petitioner. The Chief General Manager, Sijua Area considered the petitioner's claim and passed reasoned order refusing the petitioner's claim of monetary compensation. It has been, inter -alia, specifically mentioned that the petitioner is not the widow of the deceased employee and, as such, she is not entitled to the benefit of monetary compensation. The petitioner has not been able to show that daughter -in -law is also entitled to get the said benefit. I, therefore, find no legal force in the petitioner's claim and contention.
