JUDGEMENT

(1.) The present application has been preferred under Section 438 of the Code of Criminal Procedure in connection with the offence registered as Contempt Case No. 125 of 2009 (T.R. No. 914 of 2010), for the offences punishable under Sections 498A, 323/149 of the Indian Penal Code,- which is pending in the Court of learned Judicial Magistrate, 1st Class, Hazaribagh.

(2.) Having heard learned Counsel for both sides and looking to the fact that anticipatory bail application bearing ABA No. 2219 of 2010 was allowed by this Court vide order dated 26th August, 2010 and the Petitioner is co-operating with the investigation and also looking to the quantum of punishment and also looking to the involvement of the present Petitioner in the offences as alleged by the prosecution, I hereby enlarge the present Petitioner on anticipatory bail.

(3.) In view of the aforesaid facts, this anticipatory bail application is allowed. The Petitioner is granted anticipatory bail. In the event of arrest of the Petitioner in connection with Contempt Case No. 125 of 2009 (T.R. No. 914 of 2010), for the offence punishable under Sections 498A, 323/149 of the Indian Penal Code, he shall be released on bail on executing a bond of Rs. 10,000/- (Rs. ten thousand only) with one surety of the like amount to the satisfaction of learned Judicial Magistrate, 1st Class, Hazaribagh on the following conditions:
