JUDGEMENT

(1.) IN this writ petition, the Petitioner has prayed for a direction on the Respondents to pay his arrear of salary for the period from February, 1989 to the date of his retirement.

(2.) IT has been stated that the Petitioner was Paid Manager in the office of District Cooperative Officer, Palamau at Daltonganj and was posted in Hariharganj Block. During his service period, he was entitled to get his salary, but the Respondents did not release the same on the pretext of no availability of fund. It has been submitted that from time to time payment has been made to the Petitioner, but his total arrear of salary has not been paid till date.

(3.) LEARNED G.P. IV, appearing on behalf of the State, submitted that the Petitioner was not the employee of the State Government and, in fact, the State Government has no liability for payment of his salary. However, grants have been given to the different Cooperative Societies and out of that grant, as informed, some payment has also been made to the Petitioner.
