JUDGEMENT

(1.) THE petitioner is in custody in connection with the case registered under Sections 364(A)/120(B) IPC.

(2.) LEARNED counsel for the petitioner submitted that the petitioner has been falsely implicated in this case; the only allegation against him is that he was only present; there is no specific allegation of any overt against him; the victim has not identified him; he is in custody since March 2010; he is a local permanent resident and there is no chance of his absconding.
