JUDGEMENT

(1.) At the outset, State counsel submitted that petitioner has got remedy of appeal.

(2.) On this, Mr. Samir Prasad, learned counsel for the petitioner, sought permission to withdraw this writ petition with liberty to the petitioner to move the appellate authority. He further submitted that petitioner has not gained anything by the delay and therefore the delay may be condoned.

(3.) In the circumstances, petitioner is permitted to withdraw this writ petition with liberty to him to file an appeal before the appellate authority.
