JUDGEMENT

(1.) ANTICIPATORY bail application filed by petitioner Indranil Chowdhury in connection with Chirkunda ( Maithan) P.S. Case No. 160 of 2004 ( G.R. No. 2603 of 2004) pending in the court of Chief Judicial Magistrate, Dhanbad is moved by Sri. A.K. Kashyap, Sr. Advocate and opposed by Sri S.K. Ughal, learned counsel for the O.P. No. 2.

(2.) IT appears that petitioner entered into an agreement for changing conductors and other items from Durgapur to kalipahari and from Durgapur to Burdwan. In the said agreement, there is specific stipulation that petitioner will return old conductors. IT is alleged that the said conductors not returned by petitioner and he misappropriated them. IT is further alleged that by the conduct of petitioner, DVC sustained loss of Rs. 94,00,000/- and odd.
