JUDGEMENT

(1.) THE petitioner is an accused in the case registered under Sections 302/34 of the Indian Penal Code.

(2.) LEARNED counsel appearing on behalf of the petitioner submitted that the petitioner has been falsely implicated in this case as he happens to be the father-in-law of the deceased; the only allegation is that he used to instigate his son for second marriage; there is no allegation of any overt act against the petitioner; he is an old man; the petitioner is in custody since July, 2010; he is a local permanent resident; there is no chance of his absconding.
